Forty-Nine Congressmen have sent a letter to Attorney General William Barr asking him to investigate Planned Parenthood, the nation’s largest abortion provider, for potentially “deliberately killing a partially delivered baby.”
The letter is dated September 24, 2020 and informs the Attorney General that “abortion providers within Planned Parenthood may be violating the Partial-Birth Abortion Ban Act of 2003.”
The law prohibits abortions where the baby is mostly delivered, except for its head, and then killed.
The letter cites a video released on August 24, 2020 by the Center for Medical Progress (CMP) in which Planned Parenthood executive Tram Nguyen states under oath that she has seen aborted babies come out “a little too intact.”
“As a pro-life American and OB/GYN who worked for over 25 years to save the lives of both mothers and babies, it is beyond sickening to see and hear confessions of such heinous acts being committed in our country,” U.S. Congressman Roger Marshall, R-Kan., who authored the letter, said. “I am committed to standing up for the life of all babies, born and unborn. We must hold these physicians and the organizations backing and supporting them accountable for their actions.”
The 5-4 Supreme Court opinion upholding the 2003 law is Gonzalez v. Carhart. Retired Associate Justice Anthony Kennedy wrote the majority opinion, while the late Justice Ruth Bader Ginsburg wrote the dissent.
A partial-birth abortion, also called an “Intact Dilation & Extraction,” takes place during the second trimester of a pregnancy. The process involves extracting the preborn baby until its head “lodges in the cervix.” In his opinion Justice Kennedy cited a nurse who witnessed Dr. Martin Haskell perform the abortion. The nurse described the procedure this way (warning: graphic description):
“Dr. Haskell went in with forceps and grabbed the baby’s legs and pulled them down into the birth canal. Then he delivered the baby’s body and the arms—everything but the head. The doctor kept the head right inside the uterus… The baby’s little fingers were clasping and unclasping, and his little feet were kicking.
“Then the doctor stuck the scissors in the back of his head, and the baby’s arms jerked out, like a startle reaction, like a flinch, like a baby does when he thinks he is going to fall. The doctor opened up the scissors, stuck a high-powered suction tube into the opening, and sucked the baby’s brains out. Now the baby went completely limp… He cut the umbilical cord and delivered the placenta. He threw the baby in a pan, along with the placenta and the instruments he had just used.”
These 49 Congressmen are concerned that Planned Parenthood may have preformed a partial-birth abortion, as described above, despite the procedure being illegal.
“We respectfully ask that in light of the recently unsealed testimony, the Department investigate whether Planned Parenthood has violated the Partial-Birth Abortion Ban Act,” the letter concludes.
