Texas Supreme Court Sides Against Planned Parenthood, Refuses to Block Heartbeat Bill

The Texas Supreme Court has turned down a request from Planned Parenthood to allows its lawsuit against the state’s Heartbeat Bill to proceed.

The law being challenged by Planned Parenthood, Senate Bill 8 (SB8), outlaws abortion in the state after a preborn baby’s heartbeat can be detected, which generally occurs around 6 weeks of pregnancy.

According to the Texas Tribune, a Texas state district court had indefinitely paused Planned Parenthood’s lawsuit against SB 8. “Planned Parenthood [had] asked the court to declare the abortion law … unconstitutional.”

Planned Parenthood had appealed this pause to the Texas Supreme Court, which now ruled against the abortion giant.

Kimberlyn Schwartz, media and communication director for Texas Right to Life, celebrated the ruling in a statement.

“We are thankful that Planned Parenthood’s attempt to shortcut the normal process of litigation was again denied,” Schwartz said.

“In 2020, about 54,000 unborn babies were aborted in Texas, and about 85 percent happened after six weeks of pregnancy, according to state health statistics,” LifeNews reports. “That means the new Texas law is saving as many as 100 babies’ lives every single day.”

Texas SB8 officially went into effect on September 1, 2021. The same day, the U.S. Supreme Court in a 5-4 vote refused to block the law from taking effect.

This means that since September 1, if LifeNews’ estimates are correct, upwards of 3,500 babies have already been saved from abortion under Texas’ new law.

With the Texas Supreme Court’s most recent decision, around 100 preborn lives will continue to be saved each day in The Lone Star State.

The success of SB8 has caused other states to take notice.

One Florida state representative has already sponsored a bill in the state’s legislature which, as The Daily Citizen reported, “copies in every pertinent regard the provisions of the recent Texas heartbeat law that went into effect September 1.”
